Terms of service

These are the terms on which we provide Flipr. By building or publishing a game you agree to them.

Who we are

Flipr is operated by Lindon East LLP, 37 East Dean Road, Eastbourne, BN20 8EJ, United Kingdom. You can reach us at hello@weflip.app.

What Flipr does

Flipr turns photographs of a group of people into a flipbook game on a link of its own. You build the game, choose how it looks, and publish it so others can play.

Your account

• You need an account to save or publish a game. Building one first is free.
• Keep your sign-in details to yourself. You are responsible for what happens under your account.
• We may suspend or close an account that breaks these terms.

Photographs and details of other people

This is the part that matters most. Each time you publish, you confirm that:

• Every person shown is 18 or over.
• Every person shown has agreed to appear in your game and to their photograph being viewable by anyone with the link.
• You have the right to use the photograph, and it does not infringe anyone else's rights.
• The photograph, and the names, roles and facts you write alongside it, are not defamatory, obscene, sexually explicit, harassing or discriminatory, do not identify anyone's private home address or personal contact details, and are not intended to embarrass or single anyone out.

If someone asks to be removed, we will remove them, whatever you have paid.

Acceptable use

Do not use Flipr to publish defamatory, obscene, sexually explicit or unlawful content, to share anyone's private home address or personal contact details, to impersonate people, to harass anyone, or to break into or overload the service. Do not resell access to Flipr as if it were your own product without our written agreement.

Paying and publishing

• Building a game and previewing it is free.
• Publishing is charged. Pay as you go is worked out from the number of people in the game. Business is a single charge for one game. Unlimited is a subscription, billed monthly or yearly.
• Prices are shown before you pay. Stripe acts as merchant of record and appears as the seller on your receipt. Tax is added on top of the listed price where it applies.
• Editing a game, replacing a photograph, deleting a person or restyling the game is always free.

Subscriptions and lapsing

• Unlimited renews automatically until you cancel. You can cancel at any time and it runs to the end of the period you have paid for.
• If a subscription lapses, games you have already published stay live and playable. Subscription-only extras, such as your own logo, a custom background, profile links, a custom end-of-game link and removing our footer, switch off.
• Anything you bought outright stays yours.

Your right to cancel

Publishing a game is digital content supplied immediately. When you publish, you are asking us to supply it straight away, and you accept that you lose the 14-day right to change your mind under the Consumer Contracts Regulations 2013 for that publication.

If something has gone wrong, write to hello@weflip.app. We will sort it out, and we will refund where a refund is fair.

Who owns what

You keep ownership of your photographs, names and text. You give us permission to store them, process them and show them as part of your game, for as long as the game exists. We own Flipr itself, including the site, the game mechanic and our branding.

Taking a game down

We may unpublish or remove a game without notice if it breaks these terms, if someone in it asks to be removed, or if we are required to by law. Where we remove a game that you paid for and you have done nothing wrong, we will refund that publication.

Availability

We aim to keep Flipr running, but we do not promise it will never be unavailable. We may change or withdraw features, and we will give notice of significant changes where we reasonably can.

Our responsibility to you

We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded. Otherwise, our liability to you is limited to the amount you paid us in the twelve months before the problem arose. We are not liable for indirect or consequential loss.

If you are using Flipr as a consumer, nothing here affects your statutory rights.

Your responsibility to us

If someone brings a claim against us because of a photograph or text you uploaded, you agree to cover our reasonable costs in dealing with it.

Changes to these terms

We may update these terms. We will change the date on this page and, where the change is significant, tell account holders by email. Continuing to use Flipr means you accept the updated terms.

Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
